At Eos Positioning Systems, we are committed to the privacy of our clients, employees, and business partners. Protecting the privacy of “Personal Data” (defined below) is something we take seriously. Our products and offerings are intended for commercial use; however, they may be made available to individuals. Where our products and offerings are used by other commercial enterprises, their privacy policies apply to their use of those products and offerings. Where our products and offerings integrate with or are used in conjunction with third-party applications or technology partners, the privacy policies of those third parties govern their respective products and services. We direct you to view their websites for their privacy practices.

From time to time, we modify our privacy practices, either in response to changes in our business or operations, or in response to the changing regulatory landscape. Changes we make will be reflected here. We encourage you to periodically visit this site to check for the latest version of our privacy policy.

What is Personal Data?

Personal Data refers to any information about an identifiable individual, whether it is a singular identifier or a collection of information which may identify an individual. It does not include information that has been anonymized in a way that an individual cannot be identified.

How and to Whom does this Privacy Notice Apply?

This notice applies to users of this website; our customers, dealers, and distributors of our products and offerings; individuals who have requested information from us; third-party service providers; employees; and contractors.

Types of Personal Data We Process

We process personal data for multiple purposes, which varies based on the relationship you have with us. The information we collect for processing may be in multiple forms (e.g., digital, paper, verbal, or voice recording) for these purposes:

(a) To consider initiating and to initiate, maintain, and develop our relationship with you in connection with our offering products and offerings generally, and to otherwise analyse and manage our business;

(b) To administer transactional accounting services and security measures in relation to your business with us;

(c) To administer financial transactions (e.g., payments, collections, payroll, etc.);

(d) To comply with legal and regulatory requirements; and

(e) To promote and to market products and other offerings provided by (i) Eos Positioning Systems and/or (ii) its affiliates or agents including by means of direct marketing.

How We gather your Personal Data

Eos Positioning Systems will not collect, use, or disclose your personal information without your consent, except where required by law. Nor do we sell your personal information to third parties. We collect your Personal Data directly from you, including information obtained from cookies on our website. Our website allows you to opt in or consent to our collection of information for the purposes of understanding how you engage with our website, to provide you with customized advertisements based on your historical browsing activities, and to analyze the effectiveness of those marketing campaigns. If you do not opt-in or provide consent, we collect only the necessary information, which does not include Personal Data, to enable website features. You also provide direct consent and some Personal Data to us when you subscribe to any of our newsletters and/or request marketing, sales, technical support, or other information via email. In some circumstances, we obtain your information through our dealers and distribution partners or similar agents.In all cases where you subscribe to a communication, you may opt out of that communication by choosing the unsubscribe option in that communication. Note that when you unsubscribe from a service, such as a newsletter, you are unsubscribing only from that service. You may still be contacted directly by an Eos Positioning Systems representative. If you do not wish to be contacted by any Eos Positioning Systems representative ever, you must request to have your information deleted directly from privacy(at)eos-gnss(dot)com.

When you consume our products and offerings, we may obtain and process information, such as product models and serial numbers. Some of our apps connect to our servers and offer you the ability to install updates. We may keep track of anonymized information — such as whether an update was successful and to validate that you hold a valid license to our products, apps, and offerings — via third-party analytics providers.

We use various marketing automation platforms for sending emails which contain your contact information and track behaviour related to those emails, including whether you have received or opened the email, opened an attachment or clicked a link in the email, or forwarded the email. You can opt out, at any time, from receiving our marketing emails, by managing your preferences or unsubscribing.

What Personal Data do we collect?

The type of Personal Data we collect will vary according to the relationship you have with us and whether you requested to receive marketing and/or product information. In all cases, we will collect your name and contact information. Other information we may collect includes, but is not limited to the following:

  • Data relating to previous or ongoing business transactions with us, including financial details and payment methods;
  • Company data such as the name, location, and size of the company for which you work;
  • Unique identifiers such as customer ID, employee ID, mobile device identifiers, or cookie ID on your browser;
  • IP address and information that may be derived from IP addresses or other device identifier, such as geographic location, which we may collect via third-party services such as website analytics;
  • Visual and audio information, such as your picture or information about products and comments that you post, share with our team, or for which you give our company permission to use;
  • Information about a device you use, such as browser, device type, operating system, preferred language, use of apps, etc.
  • Data related to your use of and interaction with websites, such as advertisements clicked/viewed, sites and content areas, data and times of activities, or web searches used to locate and navigate to a website;
  • Personal identifiers of our employees, such as date of birth, government issued identification information (e.g., social insurance numbers), marital status, language preferences, banking information (for payroll purposes), performance information (e.g., complaints, warnings, change in roles and responsibilities), and information collected for the administration of benefits (e.g., group benefits plans)

Use and Sharing of Personal Data

We use (i.e., process) your Personal Data and other information to …

  • Communicate with you directly;
  • Connect you to an appropriate authorized Eos Positioning Systems representative for additional communications about our products and related offerings;
  • Provide you with our products or related offerings;
  • Offer you additional products or services, including targeted promotions;
  • Improve our products, apps, offerings, and website based on user experience;
  • Manage our business and operations; and
  • Implement cybersecurity initiatives and protect the confidentiality of your Personal Data

We use (i.e., process) the Personal Data of our employees to pay them and to complete tax reporting, administer benefits, communicate with them, and for ongoing performance evaluation and employment changes.

We may share (i.e., transfer) your Personal Data to third parties (e.g., authorized distributors, business partners); to third party providers (e.g., financial institutions, tax authorities, payroll administrators); and in accordance with applicable law(s) pertaining to governmental authorities, courts, auditors, regulators, and similar parties.

To the extent our authorized distributors or business partners (e.g., technology and app providers) collect your Personal Data, you need to obtain their respective privacy notices to understand what they collect, why, and how they process and share (i.e., transfer) it.

Our legal justifications for the collection, use (i.e., processing), and sharing (i.e., transferring) of your Personal Data are several, including the following:

  • You directly provided it and consented to its use.
  • You contracted with us (e.g., as a customer or employee) and we require this information to fulfill contractual obligations.
  • We must comply with legal and regulatory obligations (e.g., taxation, economic sanctions).
  • In the pursuance of our legitimate business interests and without compromising your rights.

When using Personal Data, we may transfer this across national borders to other countries and/or regions in compliance with applicable laws.

Eos Positioning Systems’s apps are not designed to store Personal Data. If you store Personal Data in a third-party app, you are subject to the privacy policies of that third-party provider.

Retention and Deletion

We retain Personal Data for as long as it is needed to fulfill the obligations for which it was collected (e.g., tech support, parts, and general servicing of products and services sold). We also have legal and regulatory obligations that require us to keep certain Personal Data for periods beyond the completion of the obligations for which it was collected. When we no longer need to use your Personal Data to comply with contractual, statutory, or other legal obligations, we will remove it from our systems and records. Alternatively, we may take steps to properly anonymize it so it no longer identifies you. Our statutory and legal obligations (e.g., tax laws, employment laws) contain retention periods of up to 10 years or longer (dependent on the jurisdiction) in the event we are obligated to preserve the information pursuant to court or similar orders.

Protection of Personal Data

Security of Personal Data is important. We provide reasonable administrative, technical, and physical security measures to protect it. Notwithstanding, there are no security controls that are always 100% effective, and as such, we cannot guarantee the ongoing security of your Personal Data.

To protect Personal Data, we limit access to it to authorized employees, agents, dealers, and third-party providers to only that which is necessary for them to fulfill their responsibilities related to the provision of services and obligations to you. We ensure our contractual and informal arrangements with third-party service providers reflect our expectations around the handling and safeguarding of Personal Data and will hold them accountable for ongoing compliance.

Where you have been given or created user log-in credentials (e.g. a user ID and password), you are solely responsible for securing the credentials to restrict and control access to your Personal Data. Likewise, you can control the information you share in communications through websites, apps, software, and so on by managing your security settings and periodically reviewing the permissions set in each. For example, where possible, you may activate two-factor authentication (2FA) on apps containing sensitive information, thereby providing more security beyond just having the log-in credentials. You may also remove apps you no longer use to stop their collecting data in the background and set location access permissions to “while using the App” rather than “always.”

Personal Data obtained electronically is stored on the servers of our third-party providers, which may be located across national borders worldwide. Personal Data of employees that may have been collected in physical form are stored in secure storage in our offices, or in offsite back-up /archived storage locations.

Eos Positioning Systems’ hardware and apps do not collect data apart from anonymized analytical data. It is up to the discretion of an end user whether you choose to use a third-party software to collect data, in which case the privacy policies of those third parties would apply.

Your Rights and Choices

Employees and candidates/applicants are directed to the employee privacy policy, which they can obtain by emailing hr(at)eos-gnss(dot)com.

Right to Access You have the right to request a copy of the Personal Data we hold about you and know how it was collected and used by us. That request must be made to us in writing at privacy(at)eos-gnss(dot)com. We have 30 calendar days to respond to your request. There are certain circumstances in which access may be denied. For example, if the information is protected by professional privilege, it if could reveal Personal Data about a third party, or if it is prejudicial to an investigation by an authorized body.

Right to Withdraw Consent You have the right to withdraw your consent at any time. For example, you may withdraw your consent to receive marketing offers and disable certain cookies. If you withdraw your consent in connection with certain products and related offerings, it may severely limit your ability to use those products and offerings, potentially resulting in denial of usage. We will advise you in advance, should that be the case, so you may make an informed decision about your withdrawal of consent.

Right to Rectification and Erasure You have the right to ask us to correct any mistakes in your Personal Data, update the information, and/or to delete certain Personal Data. As with the impact of withdrawing consent, to the extent you request us to delete certain information that is necessary for the effectiveness of the products and related offerings to which you have subscribed or purchased, there may be severe impacts to the ongoing effectiveness of those services. In connection with erasure, while you have the right to ask us to delete the information, there may be other statutory or legal reasons that we are not able to do so. In such cases, we may erase it only once those prescribed obligations have been satisfied.

Right to Transfer You have the right to ask us to provide you with a copy of your Personal Data in a machine-readable common format, to be provided to you or to a third party you specify. You may ask us to correct any mistakes in that information, update your preferences, and/or delete certain personal information.

Right to Opt-Out You have the right to manage your preferences with regards to marketing communications, including the right to unsubscribe from communications at any time. While visiting our website, you have the right to opt-out of targeted cookies that are not essential to the functioning of the website.

Minor’s Rights Our products and related offerings are not intended for minors (i.e., children under 13 years of age), and we do not knowingly collect their Personal Data. If we learn that we have collected Personal Data of a minor, we will delete that information. Note that we do not collect dates of birth except in the case of employees, and we do not employ minors. If you are a minor who has submitted your data to our company, we request you notify us at privacy(at)eos-gnss(dot)com so we may delete your data.

Your Choices We provide you with choices regarding our marketing practices. You must opt-in and consent for us to directly market or communicate with you. You can withdraw your consent and opt-out at any time. We use cookies and similar technologies to make our website work and to learn more about users of our site. We offer you the choice to turning on/off those technologies where they are not essential to the operating of the website. Examples of essential cookies include authentication cookies (e.g., log-in), load-balancing cookies (e.g., a connection between user’s web server and our back-end server). At any time, you may change your preferences, and at each time that you open our website, you will be prompted to make a choice. You also may, with your internet browser, manage your cookie settings and preferences directly, including by deleting cookies, browsing history, and other activities that collect and store data.
